Trained teachers should get pension as per their grade: Bombay HC

MUMBAI: The Bombay high court has ruled that trained teachers should be given pension applicable to employees in their grade as it would be illegal and unjustified to give them pension of untrained teachers.

Accordingly, justices SJ Vajifdar and MS Sonak recently directed the civic body in Mumbai to pay pension to an assistant trained teacher, who retired from the same post after 27 years of service in a municipal school, on the basis of the pension applicable to a trained teacher.

Charumathi Kannappa Mudaliar, right from the date of her appointment and up to the date of her retirement, i.e. upto October 31, 2009, was paid salary and other benefits payable to an assistant trained teacher.

There is no dispute that the service conditions of Mudaliar entitled her to draw pension upon superannuation. However, for a period of about two years, no pension was paid to her. Ultimately, pension payments commenced on the basis that she had superannuated as an assistant untrained teacher.

There is a difference in the pay scales of Assistant trained teachers and assistant untrained ueachers. This difference naturally persists in the pensionary benefits as well.

After hearing the arguments, the court ruled that she is entitled to pension applicable to trained teachers and hence asked the municipal authorities to pay pension accordingly.

They have been asked to pay her the difference in the pension amounts of trained and untrained teachers and also pay interest of 12 per cent on these arrears by September 2015.

The impugned action was defended, saying Mudaliar's initial appointment as an assistant trained teacher was defective. The qualifications for appointment of assistant trained teacher was SSC/HSC with Diploma in Education (D.Ed), while she had B.A. and B.Ed (Physical Education and History) degrees.

Mudaliar's qualifications were not only valid in the relevant field, but were higher than requisite qualification. Despite the same, her initial appointment 27 years prior to the date of her superannuation was not only virtually annulled, but the respondents even sought recovery of the difference in pay between trained and untrained teachers.

They also resisted payment of pensionary benefits commensurate to the post of a trained teacher.

The high court quashed and set aside the impugned communication of December 29, 2011, which directed recoveries from the petitioner as regards her salary and other benefits.

"In our judgment, the action of respondents is totally unreasonable, arbitrary and violative of Article 14 of the Constitution of India", said the judges.

"There is no dispute that the petitioner possessed qualifications of B.A. and B.Ed, which are higher than the minimum prescribed qualifications of SSC/HSC with D.Ed. It is not the respondent's case that holding higher qualifications disqualifies a candidate from occupying the post," they said.

"Nor has it been contended that the qualifications possessed by the petitioner are either not appropriate or have no nexus with the post held by her for almost 27 years. The petitioner's appointment was duly approved and the petitioner throughout her service period was treated as an Assistant Trained Teacher, which clearly she was," observed the bench.

The petitioner during her entire service period has been paid salary of an assistant trained teacher. "In these circumstances, we find absolutely no justification on the part of the respondents even to suggest that the petitioner's initial appointment, made 27 years prior to the date of her superannuation, was in any manner defective," the judges said.

The judges said they found no justification in permitting the respondents to recover any alleged arrears or to deny pension or pensionary benefits commensurate to the post of the assistant trained teachers to the petitioner.

Any attempt to recover the difference from the petitioner, on the basis that she should have been appointed only as assistant untrained teacher is ex facie illegal and unjustified, the judges held.

"So also, the denial of pension and pensionary benefits commensurate to the post of assistant trained teacher, in which post she has actually discharged the duties for a period of 27 years prior to her superannuation, is also arbitrary, illegal and unjustified," the judges ruled.

Verdict on Delhi gang rape accused juvenile may be put off

NEW DELHI: The verdict on the juvenile accused in the Dec 16 gang rape case is likely to be put on hold as the Supreme Court Wednesday fixed for August 14 its hearing on a petition on the legally defined age for a juvenile.

Janata Party chief Subramanian Swamy has petitioned the apex court, challenging the law fixing 18 as the age of juvenile, and the court Wednesday asked him to inform the Juvenile Justice Board that it will hear the petition August 14.

Additional Solicitor General Siddharth Luthra told the apex court bench headed by Chief Justice P Sathasivam that he would accordingly instruct the public prosecutor to inform the Juvenile Justice Board that it should not pronounce its verdict which is scheduled for Augut 5.

The court also said that it will examine the maintainability of Swamy's petition as ASG Luthra contended that there could not be any third party intervention in a criminal matter involving a state and an individual.

Militants throw grenade at a brick farm in Manipur

IMPHAL: Unidentified militants hurled a grenade at a brick farm in interior Thoubal district of Manipur but no casualty is reported, police said on Wednesday.

The militants lobbed the grenade and also a hand-written note yesterday at the brick farm owned by M R Gopi (43) at Phundrei Kombirei village, about 45 km south-east of here, they said.

The note reportedly written by banned Kangleipak Communist Party-Malemnganba faction, asked Gopi to contact the banned outfit, sources said adding that the incident was connected with monetary demand from Gopi.

Meanwhile, police sources said all police and security posts at interior areas have been asked to remain alert and intensify patrolling within their jurisdiction because of frequent incident of attacks at private and public places by militants by hurling grenades in the recent months.

SC asks Subramanian Swamy to inform Juvenile Board to defer verdict involving minor

NEW DELHI: The Supreme Court today said that the Juvenile Justice Board (JJB) be informed not to pronounce its verdict on the alleged role of a minor in the December 16 gang rape and murder case, till it decides a PIL seeking fresh interpretation of the term 'juvenile'.

A bench headed by Chief Justice P Sathasivam asked Janata Party president Subramanian Swamy to inform the JJB on this issue and posted his case for hearing on August 14.

Advocate Anoop Bhambani, appearing for the juvenile, opposed Swamy's plea and sought more time to file response to his petition.

The Centre also opposed Swamy's plea, saying a third party should not intervene in a criminal case and any decision taken by the apex court in this case cannot be applied retrospectively.

The bench, however, said the issue raised in the petition needs to be examined along with maintainability of the plea.

Swamy has sought that the "mental and intellectual maturity" of minor offenders be considered instead of the age limit of 18 years while fixing their culpability.

After the apex court had on July 23 agreed to hear his plea, the JJB had deferred till August 5 the pronouncement of its verdict on the alleged involvement of the juvenile accused in the December 16 gangrape and murder case.

The juvenile was one of six persons who had gangraped a 23-year-old girl in a moving bus here, according to the prosecution. The victim died in a Singapore hospital on December 29.

Of the other five accused, four--Mukesh, Pawan Gupta, Vinay Sharma and Akshay Thakur--are facing trial before a fast track court. Proceedings against key accused Ram Singh abated after his death on March 11 when he was found hanging in his cell in Tihar Jail here.

The JJB has already convicted the juvenile for robbing carpenter Ram Adhar with the other adult co-accused by luring him into the same bus in which the girl was gangraped and assaulted.

The board, however, has also deferred till August 5 the pronouncement of sentence in the robbery case.

Traffic on Delhi-Haridwar highway diverted to other routes

MUZAFFARNAGAR: Traffic on the Delhi-Haridwar national highway has been diverted to alternative routes by the district authorities to ensure smooth movement of 'Kawad' pilgrims during their yatra.

Heavy traffic from Delhi to Muzaffarnagar, Roorkee, Haridwar and Rishikesh has been diverted to alternative routes, SSP Manzil Saini said.

The steps have been taken to prevent any untoward incident in the district as 'Kawad' pilgrims, who gather at Haridwar every year to take a dip in the Ganga, use the highway to carry water from the river to offer it to Lord Shiva during the 'Kawad Yatra'.

The Delhi-Haridwar national highway has been closed for traffic from July 30 to August 5.

All schools in the district have also been closed till August 5 due to the yatra.

Meanwhile, lawyers here have also announced that they will not work in courts due to closure of different routes in the district.

Sacked Bihar BJP spokesman Ramkishore Singh resigns from party

PATNA: A day after being shunted from the post of spokesman for praising Nitish Kumar, BJP leader Ramkishore Singh on Wednesday resigned from the party charging Sushil Kumar Modi with having a "dictatorial" attitude.

Singh, former BJP MLC, who was removed by the state party president Mangal Pandey from the post of spokesman on Tuesday for publicly expressing doubt over leadership quality of Narendra Modi and praising Nitish Kumar, tendered his resignation to state chief.

"I had asked party leadership to discuss the case by 11am today when no reply came I sent my resignation to Bihar party president Mangal Pandey," Singh told reporters in the assembly premises.

The former BJP state spokesman came hard on former deputy chief minister Sushil Kumar Modi alleging him of behaving in a "dictatorial" manner with party leaders and workers.

He alleged that Sushil Modi has respect for party veteran Atal Bihari Vajpayee and L K Adavni to score points in the eyes of BJP poll panel chief Narendra Modi.

Singh had on Tuesday praised Nitish Kumar and came harsh on Narendra Modi.

"Narendra Modi is an ice made up of salty water of Gujarat who will melt before reaching Delhi (becoming Prime Minister)," he said.

Singh also said the Gujarat model cannot be applied in the whole country.

"Nitish Kumar was and still is 'vikas purush' who has capacity to take everybody togther. He is definitely a PM material," the ex-BJP MLC said.

Asked if he was planning to join JD(U), Singh said he has not made up his mind so far.

Singh had attracted wrath of the leadership for airing views against Narendra Modi and also uttering that at least 35 BJP MLAs had won in the last assembly elections due to Nitish Kumar.

Jayalalithaa announces compensation to families of 16 Tamil fishermen lodged in Iranian jail

CHENNAI: Chief minister J Jayalalithaa on Tuesday announced a compensation of Rs 1 lakh each to the families of the 16 fishermen from Tamil Nadu who are lodged in an Iranian jail.

A Saudi Arabia-based company had engaged these fishermen, hailing from Ramanathapuram, Nagapattinam and Kanyakumari districts, as contract labourers on its fishing boats. Iranian authorities arrested them in December last, on charges of venturing into their waters.

According to reports received here, an Iranian court sentenced them to six months in jail and imposed a fine of $5750 on each of them. Their jail term ended in June, but they could not return home for want of resources to pay the fine.

On Sunday, Jayalalithaa sent a mail to Prime Minister Manmohan Singh urging him to personally intervene and instruct the Indian embassy in Saudi Arabia to pay the fine and to ensure the safe release of the fishermen. She said it was shocking that the fishermen were not able to contact the Indian embassy in Tehran.

"No effort has been made by the Indian embassy to establish contact with them or to provide legal assistance to them or to put any pressure on the employer to secure their release by settling the fine amount," she said.

US drone strike kills 3 Qaida suspects in Yemen: Tribal source

ADEN: A US drone strike killed three suspected al-Qaida militants at dawn on Tuesday in the second such attack in Yemen in three days, a tribal source told AFP.

"The car in which the three were travelling — two Yemenis and a Saudi — was blown to pieces and all of them were killed outright," the source said.

The attack struck in Shabwa, a southern province that borders Abyan, where Saturday night's strike hit.

"It was carried out by a US drone," the source said.

Workers missing after multiple explosions at US gas plant

TAVARES, FLORIDA: All workers at a Florida gas plant rocked by a series of explosions have been accounted for after as many as 15 were initially feared killed, authorities say.

John Herrell of the Lake County Sheriff's Office said early on Tuesday that all the workers at the Blue Rhino propane plant had been accounted for and that no fatalities had been reported after explosions hit the plant late Monday night. Seven people were injured and transported to local hospitals.

Herrell earlier had said 15 workers were unaccounted for after the blasts, but all were later found safe.
He said a crew of 24 to 26 people were working at the plant on an overnight shift when the explosions occurred late Monday. He said seven people were injured and transported to a local hospital and two employees escaped unharmed.

Video footage on WESH-TV in Orlando showed fires burning through trucks used to transport propane tanks, which were parked at the plant. The fire was sending plumes of smoke into the air nearly two hours after the blast. Emergency crews could also be seen massing nearby.

Herrell said an evacuation zone was initially a one-mile (1.6-kilometer) radius but had been reduced to a half-mile (800-meter) radius. No injuries have been reported from residents in the neighborhood.

Herrell said officials believe the fire is contained and won't spread to another part of the plant but they cannot guarantee that.

Bryan Koon, director of the Florida Division of Emergency Management, said he was still getting "preliminary information" from local authorities.

The blasts began about 11pm.

Herrell said the plant usually has 53,000 20-pound (9-kilogram) propane tanks.

According to the Leesburg Daily Commercial, the plant was built in 2004 and employs fewer than 50 people.

JetLite flight makes emergency landing at Mumbai airport as engine fails

MUMBAI: A Bhopal-bound JetLite flight from Mumbai with 114 passengers on board made an emergency landing here on Tuesday morning due to engine failure, airport officials said.

The flight returned to the city airport after being airborne for over half an hour, they said.

The flight landed safely and it later departed for its destination after the problem was rectified.

"JetLite flight 9W1625, that had 114 passengers on board, took off at 5.47am but landed back at 6.20am due to port side engine failure," Mumbai airport spokesperson said.

The flight took off for Bhopal at 10.40am, the spokesperson said.

Bihar BJP sacks spokesman Ram Kishore Singh for anti-Modi remarks

PATNA: Bihar BJP president Mangal Pandey on Tuesday sacked state party spokesman Ram Kishore Singh from his post for his reported anti-Narendra Modi remarks and served him a showcause asking him to explain his conduct.

The party leadership will decide on further action against Singh if his explanation was not found to be satisfactory, Pandey told reporters.

Singh had created a flutter on Monday by questioning the Gujarat chief minister's capability to lead BJP-led NDA to victory in the next general elections.

"There is serious doubt about Modi's capability to lead NDA to power with majority in the next general elections," he had told reporters on Monday.

A former BJP MLC, Singh had been sulking after the party leadership did not nominate him for another term last year.

He had reportedly met chief minister Nitish Kumar on Monday and lavished praise on the latter. He had said at least 35 BJP MLAs had won the last assembly polls in the state due to campaigning by Kumar.

Jammu-Srinagar highway hit by landslides, closed for traffic

JAMMU: The Jammu-Srinagar National Highway was closed for traffic on Monday due to landslides in Udhampur district, leaving 200 vehicles stranded.

The landslides hit the highway at Samroli area of the district, police said.

The men and machines of Border Road Organization (BRO) have started clearance operations in the area.

However, a cavalcade of vehicles carrying Amarnath pilgrims to Kashmir Valley had crossed the area before the landslides hit the highway.

Five dead, including child, in US helicopter crash

NOXEN (US): A helicopter crash in a rugged, wooded area of Pennsylvania claimed the lives of five people, including one child, officials have said.

The crash happened on Saturday night after the pilot told air traffic controllers he was losing altitude, according to the county coroner.

Wyoming County coroner Thomas Kukuchka said the pilot contacted a nearby tower around 10:30 pm local time saying he would attempt to return to another airfield nearby.

Although the names of those on board have not been released, Kukuchka said three men, a woman and a child were on board.

"It appears to be a father and son, a father and daughter and the pilot," he said.

Kukuchka did not release the ages of the victims. He said his office was trying to reach family members of the deceased in Virginia, Maryland and Pennsylvania.

The Federal Aviation Administration said the helicopter took off from Greater Binghamton Airport in New York but officials there said it had actually originated at a smaller airfield nearby, Tri Cities Airport in Endicott. A phone message left at Tri Cities Airport was not immediately returned last night.

State police and FAA personnel were still on the scene yesterday evening, according to Trooper Adam Reed, a state police spokesman. Additional details will be released as the investigation progresses, he said.

Although it was not clear if weather played a role in the crash, Kukuchka said there were severe thunderstorms in the area Saturday night. The coroner and police said rough weather contributed to the difficulty of the search; the wreckage was located shortly before 2 pm yesterday.

The FAA said the helicopter was bound for Jake Arner Memorial Airport in Lehighton.

The National Transportation Safety Board will lead the investigation, the FAA said.

Security lapse led to Assam blast: Tarun Gogoi

MARIANI (Assam): Admitting that "security lapse" had led to the blast here that left 15 people injured, Assam chief minister TarunGogoi on Monday said the PareshBarua-ledUlfa (Independent) was responsible for the act.

The Ulfa (I) had carried out the blasts with the "help of outside agencies" in Paltanbazar area of the city, he said at a sidelines of a function here.

Gogoi said there "must have been some security lapse otherwise yesterday's blast would not have taken place".

"These outside agencies do not want development in the state and as such they are pressuring the insurgent outfits active in the state to carry out such blasts", he said.

"If there is development in Assam, the problem of unemployment will end and youth of Assam will not join any insurgent outfit. As a result, these outside forces will lose ground," the chief minister said.

He said a high-level security meeting will be held this evening and directed the officials to take necessary steps to prevent further outbreak of such incidents.

Referring to AGP and BJP's allegation of the state government having failed to check violence, the chief minister said that during NDA's rule, 410 people had died in blasts in the state but in recent years only 52 people have died.

"Moreover, it was during the AGP's rule in the state that the dangerous secret killings had taken place," Gogoi said.

The blasts in the Paltanbazar area of Guwahati was the third incident within in a week with the first in Lakhimpur and the other at Bokoliaghat in Karbi Anglong district.

SC refuses to entertain PIL on food security ordinance

NEW DELHI: The Supreme Court on Monday refused to entertain a PIL challenging the food security ordinance promulgated by the government three weeks ago.

A bench comprising justices TS Thakur and Vikramajit Sen declined to hear the PIL and asked the petitioner to approach the high court for redressal of his grievances.

The court passed the order on a petition filed by advocate ML Sharma alleging that the Centre has brought the ordinance for political purposes and the court should examine its validity.

The bench, however, made it clear that the court cannot examine the ordinance on the ground that there is political dimension or objective behind it.

It asked the petitioner to approach the high court to raise other grounds for challenging validity of the ordinance.

The petition sought quashing of the ordinance alleging that the constitutional provision has been misused for pre-election propaganda and political gains.

President Pranab Mukherjee had on July 5 signed the ordinance on food security to give the nation's two-third population the right to get 5kg of food grains every month at highly subsidised rates of Rs 1-3 per kg.

The petition said Article 123 of the Constitution that deals with the power of the President to promulgate ordinances during the recess of Parliament has been misused as there was no "emergency" situation.

Moderate intensity earthquake hits Kashmir Valley

SRINAGAR: A moderate intensity earthquake, measuring 5.5 on the Richter scale, on Monday hit Kashmir Valley but there was no report of any damage due to it.

The quake, the epicentre of which was in Hindukush region of Afghanistan, hit the Valley at 1330 hours, an official of the MET department said.

He said the coordinates of epicentre were 36.6 degrees north on latitude and 70.6 degrees east on longitude.

There was no report of any damage or casualty due to the tremor so far, the official added.

Smoke in cockpit diverts Qantas flight in Australia

SYDNEY, New South Wales: A Qantas flight was forced to divert to Canberra on Monday due to smoke in the cockpit, the Australian airline said.

The Dash-8 Q300 domestic flight had been heading to the New South Wales city of Wagga Wagga when it made the landing in the national capital.

"A flight from Sydney to Wagga Wagga was diverted to Canberra due to some smoke in the cockpit," a Qantas spokeswoman said in a statement, adding that the aircraft had landed safely.

"We are currently investigating the cause."

The Australian Capital Territory's Emergency Services Agency said fire and rescue and ambulance staff were called to the airport after reports of smoke in a plane cockpit.

"Fifty passengers including one child were safely evacuated from the plane with no injuries reported," the agency said in a statement.

"Paramedics... transported the pilot and co-pilot to the Canberra Hospital for assessment."

Will free 104 Palestinian prisoners in peace talks: Benjamin Netanyahu

JERUSALEM: Prime Minister Benjamin Netanyahu said that Israel will free 104 Palestinian prisoners to coincide with the resumption of long-stalled peace talks brokered by the United States.

"I agreed to free 104 Palestinians in stages, after the start of negotiations and according to progress," he wrote on his official Facebook page.

He did not give details on those to be freed or confirm reports that talks would open in Washington on Tuesday.

A Palestinian official earlier said that the Washington meeting would be attended by chief Palestinian negotiator Saeb Erakat, his Israeli counterpart justice minister Tzipi Livni and US officials.

The sides are expected to meet for an informal dinner on Monday evening, on the eve, he said.

Israel's regional development minister Silvan Shalom said this week that talks could resume next Tuesday, but neither the date nor venue have so far been confirmed.

"At this time, it seems most important to me that the state of Israel enter (negotiations)," Netanyahu wrote.

"This is important both to maximise the possibility of ending the conflict with the Palestinians and to solidify Israel's position in the complex international reality surrounding us," he added, writing in Hebrew.

Haaretz newspaper said the initial talks would be to lay the parameters of formal negotiations.

"According to senior officials in Jerusalem, the meeting in Washington is expected to deal primarily with the agenda for holding negotiations, including the subjects to be discussed and the timetable," according to Haaretz.

Sunday's weekly cabinet meeting will hear a formal statement from Netanyahu on the resumption of peace talks and mandate a ministerial committee to handle the prisoner release, the government website said.

Israeli news website Ynet said Netanyahu would head the prisoner committee deciding which prisoners are to be freed and when.

The cabinet is also set to endorse a draft bill to submit any peace treaty with the Palestinians to a referendum.

Such a vote would be a final endorsement of a treaty after ratification by the government and Parliament.

A briefing paper published by the cabinet office said the proposal comes "in light of the significant diplomatic developments accompanying the opening of negotiations by the state of Israel with the Palestinian Authority".

The draft is seen as a gesture to right-wing ministers apprehensive of concessions that could be demanded of Israel

The cabinet paper said the government saw approval of the new draft as "urgent and important" and said it would be asking parliament to streamline its passage into law.

Cambodian Prime Minister Hun Sen set for victory in tense election

PHNOM PENH: Cambodians voted on Sunday in an election likely to hand another five years in power to Asia's longest-serving Prime Minister Hun Sen, but an energized opposition says there have been irregularities and it will continue to fight for true democracy.

The opposition believes nearly a million names are missing from voter lists and has complained about the disruption of meetings, alleged vote-buying and campaigning by the security forces for Hun Sen, who defected from the genocidal Khmer Rouge and was first appointed premier in 1985.

"The partisanship of the military and police has created an intimidating atmosphere for voters in many parts of the country," US-based Human Rights Watch said in a statement.

The ruling Cambodian People's Party (CPP) is confident of victory but political analysts believe a stronger opposition may dent its majority.

More than 9.6 million people are eligible to vote, with polls opening at 7am (0000 GMT) and closing at 3pm (0800 GMT). Early results may come on Sunday evening.

The opposition Cambodia National Rescue Party (CNRP) has been buoyed by the return home of a popular party leader, former finance minister Sam Rainsy, after a royal pardon.

Sam Rainsy had faced the threat of a jail sentence handed down in 2010 for spreading disinformation and falsifying maps to contest a new border agreed with Vietnam, charges he called politically motivated.

He returned to Cambodia too late to register to run in the election, or even to vote, and the electoral authorities rejected his late request to do so.

But Sam Rainsy has campaigned strongly for the opposition, attracting large crowds, and has complained to international observers of irregularities in the running of the election.

"In spite of this uphill battle, any gain we make will be very significant. The election is not the end of our fight, it will be the beginning of the fight for real democracy," he said on Saturday.

Under Hun Sen, Cambodia has been transformed from a war-torn basket case into one of Southeast Asia's fastest growing economies, helped by a burgeoning garment export industry and growing political and investment ties with China.

But the breakneck economic growth has been accompanied by a rise in social tensions over poor factory conditions and rural land rights in the country of 14 million, where a third of people live on less than 65 US cents per day.

Hun Sen's CPP is a formidable electoral machine, with millions more party members, that easily outguns the opposition. Adding to its advantages is a compliant media, its deep pockets, and an election system that is prone to government meddling.

"The CPP has 5.7 million members; the other party has only just over a million," said CPP lawmaker Cheam Teap, confident of victory in Sunday's ballot.

Hun Sen's CPP had 90 of the 123 seats in the outgoing parliament while the CNRP had 29.

CPP's Cheam Yeap said the ruling party would win between 88 and 92 seats, but some analysts believe the opposition has its best chance in years of denting the CPP majority.

"The opposition will gain more seats, judging by all the support we've seen," said independent analyst Chea Vannath.

"But regardless of how many more seats the parties get, they should be united for the country rather than confronting each other," she added, advocating a government of national unity.

Alcohol sales and political campaigning were banned for 48 hours from midnight on Friday to ensure calm.

Government ready to share classified water data at a cost

NEW DELHI: Amid a raging debate over greater transparency, the government is ready to part with classified hydrological data at a cost, provided the user is able to convince a panel about the requirement.

Both Indian and foreign users can apply for the classified water data.

While "Indian non-commercial users" will be provided with the information free of cost, "Indian commercial and foreign users" will be provided the classified hydro data at a cost of Rs 75,000 per site, per annum.

The classified data will be released for a specific purpose or study and will be non-transferable.

According to the just released Hydro-meteorological Data Dissemination Policy, 2013, there is a ban on reproduction of the classified data in any report or publication or detailed project report.

"Only result of analysis and inferences drawn thereof should be published," says the policy prepared by the ministry of water resources.

In a bid to make the process of disseminating the classified data stringent, the policy has proposed a two-stage process.

Those seeking to use the data will have to approach a designated chief engineer of the Central Water Commission (CWC) with a secrecy undertaking.

The official would first verify the authenticity of the user, the purpose for which the data has been requested and the minimum amount of data required for the purpose.

He will forward the request along with his recommendations to the 'Classified Data Release Committee' which will take a final call on the issue.

The committee will have four senior officials of the water resources ministry and one representative of the ministry of external affairs.

The policy admits that one of the reasons behind sharing data is the "increasing demand" by the community that statistics collected using public funds should be made "more readily available to all for facilitating rational debate, better decision making and in meeting society's needs".

From the point of view of data dissemination, the nation has been divided into three regions: Region-I: Indus basin and other rivers and their tributaries discharging into Pakistan; Region-II: Ganga-Brahmaputra-Meghna basin and other rivers and their tributaries discharging into Bangladesh/Myanmar; and Region-III: Remaining other rivers and their tributaries.

According to the policy, while the data of Region-I and II are classified, the data of Region-III is unclassified.

The reservoir water level, live storage position, water quality, groundwater and meteorological data for all regions are also unclassified.

UPA coordination panel to meet on July 31 on Telangana

NEW DELHI: A meeting of UPA coordination committee has been called on July 31 to take a view on the vexed Telangana issue amid indications from the party that creation of a separate state is now a 'fait accompli' despite the complications attached to it.

Senior party leaders from the state said that creation of a separate state appears to be a fait accompli but the party will gave to address complications attached with it.

A CWC meeting is also expected to be held after the coordination committee meeting.

With the top Congress leadership appearing to have veered towards creation of Telangana, Congress MPs from rest of Andhra Pradesh have opposed any division of the state while a party MP from Telangana region had said that the government should go ahead with the decision.

The six anti-Telangana MPs, including Union ministers MM Pallam Raju, KS Rao, Chiranjeevi and D Purandeshwari (all hailing from coastal Andhra) and K Bapiraju and Anantarami Reddy had met Prime Minister Manmohan Singh in a delegation to push for keeping Andhra Pradesh united.

The MPs told Prime Minister that there would be repercussions not only for the state but also for the entire country if Andhra Pradesh is divided.

Rao said after the meeting that any decision to split the state would create problems. It was not in the interest of the people nor the various regions of Andhra Pradesh, he said.

Bapiraju had said the delegation told the Prime Minister that formation of Telangana will create problems in many states including Maharashtra, Uttar Pradesh and Madhya Pradesh where there are demands for separate statehood.

Suicide car bomb hits Iraq's Kurdish patrol, kills eight

BAGHDAD: A police official said a suicide car bomber rammed his vehicle into a Kurdish security patrol in northern Iraq, killing eight.

Colonel Hussein Ali Rasheed, who is police chief of TuzKhormato, said the bomber struck on Sunday morning as the patrol was passing through the ethnically-mixed town.

He said five more were wounded.

Tuz Khormato sits in territory contested by Arabs, Kurds and Turkomen about 200 kilometres (125 miles) north of Baghdad. Iraq's Kurdish self-rule zone maintains its own security forces.

The attack comes amid an increase in violence that is raising fears of a return to the widespread sectarian killing that pushed the country to the brink of civil war after the 2003 US-led invasion. More than 3,000 have died since April.

Batch of over 400 pilgrims leave for Amarnath

JAMMU: A batch of 440 devotees today left the Jammu base camp for the Amarnath cave shrine in south Kashmir, police said.

A convoy of 16 vehicles, carrying the 30th batch of 440 devotees, left the Yatri Niwas at Bhagwati Nagar at around 4:50am to pay obeisance at the cave shrine in the Kashmir Valley, police said.

The batch, includes 284 men, 62 women and eight children, apart from 86 priests, are on their way to twin base camps of Pahalagam and Baltal in the Valley, they added.

With today's batch, a total of 48,714 pilgrims have left Jammu base camp for Amarnath so far.

Molester of woman in running train held in Hooghly district

HOWRAH: The man, who allegedly molested a woman in an empty ladies compartment in a Howrah-bound train forcing her to jump outside, was arrested from neighbouring Hooghly district.

Superintendent of railway police, Howrah, Milan Kanti Das said Debshankar Shaw, father of six daughters, was arrested last night from Makhla locality of Uttarpara.

He was charged with molestation and snatching. A 25-year-old woman had jumped off from the Howrah-New Delhi Janata Express near Belur station in the district to save her honour from the molester and got injured on Sunday evening.

The railway police on Friday released a sketch of the accused.

The woman's mobile phone allegedly snatched by Shaw, however, could not be found as he had sold it, Das said, adding efforts were on to find out its buyer.

2G case: AIIMS doctors examine Karunanidhi's wife Dayalu Ammal

CHENNAI: A team of doctors, from the All India Institute of Medical Sciences (AIIMS), New Delhi, examined the physical condition of DMK chief M Karunanidhi's wife Dayalu Ammal (82) at her residence in Chennai on Saturday.

The doctors — Dr AB Dey (professor of medicine and chief, geriatric services), Dr Manjari Tripathi (professor of neurology) and Dr Nandakumar -- landed in Chennai airport at 9.40am and went to the state guest house in Chepauk. They reached Dayalu Ammal's Gopalapuram residence at 11.20am and the examination continued till 1.10pm.

Karunanidhi left for his party office immediately after the doctors' team started examining her.

Dayalu's daughter Selvi Selvam and family doctor Gopal assisted the doctors.

The Supreme Court had directed the AIIMS director to constitute a medical board to examine her health condition to ascertain whether she was fit to testify as a witness in the 2G case.

Justices GS Singhvi and KS Radhakrishnan had ordered that a team of doctors be constituted within a week and that it should submit its report within three weeks.

Selvi had filed a petition in the apex court and pleaded that a medical team be constituted to find out whether her mother was fit to travel to Delhi from Chennai to depose before the CBI special court.

In her petition, Selvi said her mother was diagnosed with cognitive and behavioural abnormalities in June last year and that she was progressively and gradually losing recognition of even her near and dear ones and was unable to move out of the house on her own.

19 students fall ill after eating midday meal at school in Goa

PANAJI: At least 19 students of a government-aided high school at Pernem Taluka in Goa fell ill after eating mid-day meal today, officials said.

While a girl was hospitalized at a primary health centre in Tuem, nearly 40 kms from here, rest of the students of the Kamleshwar High School were discharged after initial treatment, they said.

The girl suffered bouts of vomiting after consuming the meal while others felt uneasy, the officials said.

Though the girl is reported to be out of danger she is under observation.

"It is yet to be ascertained whether the incident happened due to food poisoning," an official said.

The affected kids are students from class V to class VII, he said.

Initial reports said that a spider was found in the meal but the official dismissed them as a "rumour".

The job of serving the mid-day meal was assigned to an NGO, Brahmanandacharya Self Help Group. The concerned NGO has also been serving the meal to 13 primary schools and eight secondary schools, officials said.

This is the second such incident which has hit the state during this week.

Earlier this week, around 22 students from St Joseph High School were referred to the hospital due to suspected food poisoning after eating the midday meal.

Hearing in Sankararaman murder case adjourned to August 12

PUDUCHERRY: A court here on Friday warned that it would issue arrest warrants if all the 23 accused, including two seers of the Kanchi Mutt, in the Sankararaman murder case failed to appear before it for the next hearing on August 12.

When the case came up for hearing before principal district and session judge C S Murugan, only five of the 23 accused in the case were present in the court.

Taking a serious view of absence of Kanchi Sankaracharya Jayendra Saraswathi and his junior Vijayendra Saraswathi and 16 other accused, the judge said all the 23 accused should be present at the next hearing, failing which warrants would be issued against them.

He then adjourned the case to August 12. The two sankaracharays are the prime accused in the murder of Sankararaman, the manager in Varadaraja Perumal temple in Kancheepuram, on September 3, 2004.

Government-run primary school teachers caught cheating in examination

KENDRAPARA: Twenty-two teachers of government-run primary schools appearing for the certified training (teaching) examination were caught cheating in Kendrapara district, official sources said today.

The teachers, who had no qualification for training, were writing the examination yesterday, they said.

Tamil Nadu DGP defends state action on assault of BJP leaders

CHENNAI: Countering the BJP's claims that fundamentalist forces were behind the attacks on party leaders in the state, the Tamil Nadu government clarified on Friday that some of the attacks were due to personal motives and in some cases, the accused belonged to the same religion.

The government's two-page statement has come a day after BJP claimed that the issue of assaults against party leaders would be raised in Parliament. On Thursday, chief minister J Jayalalithaa had convened a high-level review meeting at her Kodanad residence, on the law and order situation, with chief secretary Sheela Balakrishnan, home secretary Niranjan Mardi and director general of police K Ramanujam.

In an official release, Ramanujam said that the statements seeking to create an impression that a large number of targeted attacks had gone unchecked or undetected or that the police had failed to take action, were misleading and contrary to the truth.

"Tamil Nadu police has taken proper steps and made arrests in cases of assault on leaders of Hindu organizations," he said, and went onto add: "Some of the accused have been detained under National Security Act (NSA) or Goondas Act."

The police officer said that BJP general council member Pugazhendhi was killed in Nagercoil in July last owing to problems in a money transaction, while the party's state medical wing secretary Aravind Reddy met a similar fate in Vellore in October due to same reasons. Land dispute claimed the life of BJP Paramakudi town secretary Murugan.

Work on world's tallest building stopped in China: Report

BEIJING: Work on a Chinese skyscraper aiming to be the world's tallest building has been ordered to stop just days after breaking ground, local media reported on Thursday.

"Relevant authorities" had ordered a halt to work on the Sky City tower in Changsha, in the central province of Hunan, "because it did not complete the required procedures for seeking approval to start construction", the Xiaoxiang Morning Post newspaper said.

At 838 metres (2,749 feet), the tower would surpass the world's current tallest skyscraper, the Burj Khalifa in Dubai, by 10 metres.

Ground was broken on the project at the weekend, the company behind it, Broad Group, said earlier this week, adding that construction would take just four months once the foundations were laid.

The construction schedule has added to concerns over safety, with worries over whether the land surrounding the site could support the structure's tremendous weight.

Certain approvals were needed to assess the project's safety and environmental impact, the Xiaoxiang Morning Post said, citing unnamed authorities.

But a Broad Group spokeswoman said it had all the required permits.

The company — whose founder Zhang Yue made a fortune from air conditioners — attracted global attention last year for building a 30-storey tower in just 15 days, using prefabricated units stacked on top of one another.

It had planned to use the same technique to assemble Sky City by the end of last year, but construction work was delayed multiple times amid concerns that the plans were overambitious.

The People's Daily, the official paper of China's ruling Communist Party, has criticised the project, calling it "blind worship for ultrahigh skyscrapers" on Sina Weibo, a Chinese Twitter-like service.

China is home to three of the world's 10 tallest buildings, said the research group Emporis.

A 2011 report said China could boast four times as many skyscrapers as the United States has within five years.

2G case: Anil Ambani may have to appear as prosecution witness on Friday

NEW DELHI: Reliance ADAG chairman Anil Ambani may have to appear on Friday before a special CBI court as a prosecution witness in the 2G spectrum case as the Supreme Court on Thursday refused to give an urgent hearing on Reliance Telecom Ltd's (RTL) plea against the trial court order and posted the case for hearing on Monday.

A bench headed by Justice G S Singhvi said the matter would be listed on Monday when senior advocate Mukul Rohatgi, appearing for RTL, pleaded for an early hearing in view of the fact that Ambani has been summoned to appear on Thursday before the special CBI court.

Earlier, the apex court had said the case will be heard by a special bench, comprising justices Singhvi and K S Radhakrishnan, which is hearing all the matters pertaining to 2G scam but no date was fixed for the hearing.

Contesting the July 19 order of the special CBI court summoning Anil Ambani and his wife Tina Ambani to depose as CBI witnesses, RTL questioned the decision to call new witnesses at such a late stage of trial.

RTL, one of the three companies accused in the case, has challenged the order of special CBI Judge O P Saini, who made the ADAG chairman and his wife prosecution witnesses on CBI's plea that their testimony would throw light on ADAG's companies alleged investment of over Rs 990 crore relating to 2G spectrum in Swan Telecom.

RTL has moved the Supreme Court against the trial court's order as the apex court bench headed by Justice Singhvi had earlier restrained all other courts, including high court, from entertaining any plea arising out of the 2G case.

Fire breaks out at State Bank of Patiala head office

PATIALA: A fire broke out at the main building of the State Bank of Patiala (SBoP) on Thursday, police said here.

However, no one was injured in the fire. Fire tenders of Patiala Municipal Corporation rushed to the spot and controlled the blaze immediately, they said.

"The fire broke out due to a short circuit at the fourth floor of the Chief Managing Director ( CMD) secretariat this morning," SBoP spokesman VP Gupta said.

The sweeper sounded the alert immediately after he saw some smoke in the recovery office of the bank, otherwise more damage could have been caused, he said.

Besides recovery office, the fourth floor of the building houses offices of General Manager, Human resources, personnel and Law Department, he added.

BJP rules out major foreign policy shift, if voted to power

WASHINGTON: BJP president Rajnath Singh has ruled out any fundamental shift in India's foreign policy, if his party is voted to power.

"As far as changes in the foreign policy is concerned, there is not likely to be a basic change in its fundamental principles. But whenever the other party comes, we are having our own perspective and we decide accordingly," Singh told a group of Indian journalists here on Wednesday.

"Our foreign policy would be to have cordial relationship with our neighbours," he said, a day after he delivered a major foreign policy speech on Afghanistan at the Capitol Hill.

Responding to a question on Pakistan, he referred to a statement by the former Prime Minister, Atal Bihari Vajpayee, that one can change friends, but not neighbours.

"It would be our full effort to improve relationship with Pakistan. At the same time we expect from Pakistan to respond similarly. But till today, I can say, that Pakistan has not responded in the manner we have taken the initiatives to have a cordial relationship with them," he said.

"We are always in favour of good relationship with Pakistan," he said.

He also expressed BJP's concern on the mistreatment of minorities in Pakistan.

Togo votes in parliamentary polls delayed by protests

LOME: Togo votes on Thursday in parliamentary elections delayed by months of protests, with the opposition seeking to weaken the ruling family's decades-long grip on power in the west African nation.

The polls mark the latest step in the impoverished country's transition to democracy after Gnassingbe Eyadema's rule from 1967 to his death in 2005, when the military installed his son Faure Gnassingbe as president.

Gnassingbe has since won elections in 2005 and 2010 in the country of six million people, but the opposition has denounced both as fraudulent.

Thursday's elections are the first legislative polls since 2007, when Gnassingbe's party won 50 of 81 seats. Ninety-one seats will be decided this time.

The voting was initially scheduled for October 2012, but was delayed amid a series of protests by a coalition of opposition and civil society groups known as Let's Save Togo, which has been pushing for sweeping electoral reforms.

Many of the protests were dispersed by security forces firing tear gas, while some 35 people, mostly opposition members, were detained in the run up to the vote in connection with suspicious fires at two major markets.

Thirteen opposition members held over the fires have since been released, including five candidates in Thursday's polls.

Despite the protests in recent months, the campaign ahead of the vote has been largely peaceful, though the opposition accused pro-government militants of assaulting the convoy of one of its candidates in Kloto north of the capital on Tuesday.

The government said it was looking into the incident and could not yet comment.

Opposition members had at first threatened a boycott of the election, but they have since agreed to participate after negotiations which allowed its members access to polling places and granted them state financing for campaigning.

On the eve of the election however, opposition members accused the ruling party of planning to carry out fraud and again called for a postponement to address organisational concerns.

Jean Pierre Fabre, the most prominent opposition leader and a candidate in Thursday's vote, said he believed the population wanted change, but warned against the potential for fraud.

Asked why he did not boycott given his concerns, he said he did not want to leave the parliament without legitimate opposition voices if the ruling party maintains a majority.

"I do not want to let others be face-to-face with those in power," he said on Wednesday.

Gnassingbe's party, formerly the RPT but now known as UNIR (Union for the Republic), has called on voters to grant it a comfortable majority to continue work in areas such as infrastructure improvements.

The president should be given room to govern to continue to "improve the quality of life for the Togolese," said Patricia Dagban-Zonvide, minister of women's advancement and head of the ruling party's list of candidates in Lome.

A number of the best known opposition candidates have organised themselves into two separate coalitions, Let's Save Togo and Rainbow. Fabre's ANC party is running with Let's Save Togo.

The party of Gilchrist Olympio, the long-time opposition leader and son of the country's first post-independence president, is also taking part, though he is not himself a candidate.

Olympio, whose father was assassinated in a 1963 coup in which the current president's father took part, agreed to a deal in 2010 to have his faction of the opposition join Gnassingbe's government.

Polls are to open at 0700 GMT and close at 1600 GMT. Full results are not expected for several days.

West African bloc ECOWAS will deploy 80 observers for the vote, while the African Union will have 32.

Presidential elections in 2005 were marred by deadly violence, while 2007 and 2010 polls were viewed by observers as significant steps forward.

NEW DELHI: Reliance ADA Group chairman Anil Ambani was on Thursday exempted by a Delhi court from personally appearing before it tomorrow as a prosecution witness in the 2G spectrum allocation case.

Special CBI Judge OP Saini allowed the plea of Ambani, who was summoned for tomorrow, seeking exemption from personal appearance on the ground that he has "pre-scheduled" business engagements.

Ambani filed an application in the court, saying he had received the summon on July 23 and "owing to extremely short notice of just two days", it would not be possible for him to appear before it.

Earlier, during the day, the Supreme Court refused to grant an urgent hearing on the plea of Reliance Telecom Ltd (RTL) challenging the trial court's order summoning Ambani and his wife Tina Ambani as prosecution witnesses in the 2G case.

The apex court has posted RTL's application for hearing on Monday before a special bench, comprising justices Singhvi and K S Radhakrishnan, which is hearing all the matters pertaining to the 2G scam.

The special court had allowed CBI's plea that the testimony of Anil and Tina Ambani may throw light on alleged investment of over Rs 990 crore by his group companies in Swan Telecom, facing trial in the case along with its promoters Shahid Usman Balwa and Vinod Goenka.

RTL is an accused in the case. Three top Reliance ADAG executives Gautam Doshi, Surendra Pipara and Hari Nair are also facing trial in the case.

CBI has alleged RTL used Swan Telecom, an ineligible firm, as its front company to get 2G licences and radio waves.

However, no casualties or damage to property was reported. The first tremor was occurred at 4.42pm and the second one at 6.05pm yesterday, the sources said.

The epicentre of the tremors was about six km South East of the dam and the second one half a kilometer away of the first one, the sources said.

Coast Guard official drowns in sea after falling off patrolling boat

RAMESWARAM: A 43-year-old Coast Guard official drowned after he fell accidently in the sea from the boat off Mandapam while on patrolling, official sources said here on Wednesday.

Due to strong winds, the sea was rough when the mishap occurred last night, police said.

Jegadeshan's body was later recovered and brought to the shore, they said.

China slowdown could hit India's growth prospect: Nomura report

NEW DELHI: The slowdown in China's economy could bring down India's economic growth to 5.2% from the earlier projection of 5.5% for 2014 on weak external demand, says a Nomura report.

According to Nomura, a global brokerage firm, the slowdown in China could, however, help India contain its inflation and the twin deficits and thus create room for the RBI to cut policy rates.

With an economic slowdown reducing China's commodity demand, lower crude oil and commodity prices should help narrow India's current account deficit, reduce the fiscal subsidy burden and lower WPI inflation, Nomura said.

Nomura expects crude prices softening to result in the current account deficit for India improving to 2.3% of GDP, from 3.1%, while WPI inflation could decline to 3.8% y-o-y from its current estimate of 5.4%.

"In response to the improving twin deficits, falling inflation and a negative output gap, we believe the Reserve Bank of India would likely lower its repo rate to 6.25% versus our base case of 6.50%," Nomura said in a research note.

The rupee has depreciated by more than 10% in the last one month and crossed the psychological level of 60 per dollar in June-end and touched over 61-levels in early July.

There is a widespread speculation that the ongoing volatility in the rupee would compel the central bank to raise policy rates to stem inflationary expectations. RBI is scheduled to unveil its first quarter review of the monetary policy on July 30.

Meanwhile, China's manufacturing activity has fallen to an 11-month low in July as economic slowdown deepens in the country, an HSBC survey said. HSBC's preliminary version of monthly purchasing managers index for the country declined to 47.7 in July from 48.2 in June. Numbers below 50 on the 100-point scale show a contraction in activity.

22 die in clashes between police, gunmen in Mexico

MEXICO CITY: Clashes across the violence-plagued Mexican state of Michoacan have killed at least 20 gunmen and two federal police officers, the government said.

Gunmen blocked roads throughout Michoacan and ambushed police patrols in at least six different spots throughout the day, the interior department said in a statement.

The department said federal agents repelled the attacks, killing 20 and wounding an unknown number of assailants. Two police officers died in the shootouts and 15 were wounded on Tuesday, it said.

Fighting between the Knights Templar drug cartel and federal police has been intensifying over the past week in western Mexico.

At least four police officers have been killed in shootouts with gunmen in Michoacan since Thursday.

On Monday, five people were killed when gunmen opened fire on a group of community self-defence members gathered on a plaza in the Michoacan town of Los Reyes.

About 300 masked community vigilantes wearing similar T-shirts arrived at city hall in the town of Los Reyes and announced they would take over policing the town. Minutes later three assailants opened fired on the crowd, killing three members of the self-defence group, a police officer and a passer-by, prosecutors said.

Self-defence squads have been forming in recent months in Michoacan by people who say they are fighting violence, kidnappings and extortions carried out by drug cartels.

Also on Tuesday, authorities in the northern state of Chihuahua said police found the bodies of six men in a remote village where several homes and cars were set ablaze.

A statement from Chihuahua state prosecutors said two of the victims found in the village of Mesa de la Reforma had been decapitated and all six were shot.

Four of the victims were wearing law enforcement uniforms and bulletproof vests but are not believed to have been police officers or soldiers, prosecutors said.

The bodies were found on Monday.

Militants hurl bomb at educational institution in Manipur

IMPHAL: Some unidentified militants hurled a powerful grenade at the premises of an educational institute in Imphal west district of Manipur but it failed to explode, official sources said on Wednesday.

The militants lobbed the grenade at the complex of Little Mastern English School in interior Samurou village at around 9.30pm on Tuesday night, they said.

Police on Wednesday defused the grenade, sources said, adding that this was the second time the militants hurled the grenade at the school after May last month.

Earlier, after the May incident, school authorities had appealed to the people not to disturb the academic atmosphere in the school complex.

Sources said police posts particularly in valley districts of Imphal east, Imphal west, Bishenpur and Thoubal have been frequently put on alert because of hurling of grenades and bombs at many places.

Police posts have also been asked to step up patrolling and checking of passers-by to intercept the movement of the armed ultras within their jurisdiction, sources said.

Hyderabad seeing sharp rise in corporal punishment

HYDERABAD: Several parents complain about the physical torture and harassment faced by their children in Hyderabad's private schools, which according to authorities, is a clear indicator that despite the ban, corporal punishment is on a rise in the state.

Activists say that the rising cases of harassment, physical torture and abuse of children in schools indicate that it is essential for teachers to attend workshops and learn the difference between child abuse and discipline.

Police, in 2012, recorded 600 cases of corporal punishment, but the figure has already crossed 500 this year with five more months to go. Last week, an 11-year-old boy set himself ablaze after he was reportedly humiliated and beaten up by the principal in a school located in posh Banjara Hills in the heart of the city.

The student succumbed to his injuries and the school said they had never assessed the state of mind of the student, while imparting punishment.

In another shocking incident, a class IV student of a private school in Karimnagar district committed suicide after constant taunts and punishment from his school warden for not attending his classes.

A few months ago, a three-year-old student was threatened with a pen knife by a teacher. The parents immediately took the child out of the school and, despite the counseling session the school conducted, the boy continued to struggle with mental trauma.

"He does not want to go to school anymore and is scared even looking at objects like pen knives," said the father of the child.

A survey conducted by the National Commission for Protection of Child Rights (NCPCR) across seven states, including Andhra Pradesh, showed that 99.86% of the 6,632 children surveyed had experienced some kind of stern punishment in school.

The NCPCR survey done in 2011 also showed that 75% of them had been hit by a cane and 69% were slapped on the cheek.

The Andhra Pradesh Parents Association (APPA) says nothing has changed since then, while A Subba Reddy, the district education officer, Hyderabad, admitted that there had been a steady inflow of complaints coming in.

"We will first conduct an inquiry and then issue show cause notices to the management of the school. In case necessary action is not taken, these schools stand to lose recognition," he said.

Shanth Kumar Goel, president of APPA, says they receive at least a dozen complaints every week from parents across the twin cities of Hyderabad and Secunderabad.

"Every teacher must undergo training on how to tackle children, however problematic they may be," he said, adding that teachers in most schools are not taught how to deal with small children, who are the main victims of corporal punishment.

"The school authorities, including the principal, must be aware at all times how the students are being treated by their teachers," he added. Sections 16 and 17 of the Right to Education Act (RTE) bans corporal punishment, both mental and physical, or expulsion from school.

"The teachers are unaware of the implication of the punishment they inflict, both legally as well as psychologically, on the child. Counselling a child after the incident is not enough," said Achyuta Rao, president of AP Balala Hakkula Sangham, a child rights body. "The school management as well as parents must be counselled before the child is sent to school."

Srivyal Vuyyuri, working with child-centric NGO Sphoorti, recalled an incident where girl students in a school were made to strip on pretext of being checked for a stolen object.

"The girls were so ashamed by the incident that they did not even speak about it to anyone. It is only when other kids started talking that we found out about the incident," Vuyyuri said.

"Teachers nowadays are just not sensitized towards gender issues. And this is the case in so called elite schools as well," he added.

Panchayat elections begin in Andhra Pradesh amid clashes

HYDERABAD: Polling in the first phase of village-level local bodies in Andhra Pradesh began on Tuesday morning amid clashes between workers of rival political parties.

Four people were injured in a clash between supporters of the ruling Congress party and the YSR Congress party in Kothapalli village of Nandyal mandal in Kurnool district.

The activists of the two parties also clashed at a few places in Kadapa district.

Men and women queued up since 7 am to cast their votes in 5,903 gram panchayats in 22 districts.

According to State Election Commission, over 18,000 candidates are in the fray for sarpanch posts and 115,703 candidates for 49,729 ward members.

The polling will continue till 1 pm and the counting of votes will be taken up at 2 pm. Results for both sarpanch posts and ward members may be announced Tuesday evening.

The elections were originally scheduled for 6,140 gram panchayats in the first phase but due to heavy rains and floods, polling in 237 panchayats in six districts were postponed. Polls in these panchayats will be held July 31, in the third phase.

As many as 2,642 sarpanches have been declared unanimously elected. Congress, Telugu Desam Party and YSR Congress have all claimed that majority of these elected sarpanches belong to their party.

Andhra Pradesh has 21,592 gram panchayats, of which 21,491 are going to polls in three phases - July 23, 27 and 31.

The elections to the local bodies are being held after a gap of two years. The polls could not be held due to problems in providing reservations to various sections.

The Supreme Court in February had asked the government to conduct elections to urban local bodies and Panchayati Raj Institutions on the basis of the existing 60.5 percent quota to backward classes, Dalits and tribals.

The central government had stopped the release of statutory grants to the tune of Rs 2,600 crore to Panchayati Raj Institutions due to non-conduct of elections.

Five killed in Hyderabad wall collapse

HYDERABAD: At least five persons, including two children, were on Tuesday killed when the wall of a building collapsed on two adjacent huts in MJ Colony in Hyderabad, police said.

The incident took place at around 2am when the retaining wall of the building came down crashing. The deceased include two children, DCP (Malkajgiri Zone) V Shivkumar said.

Efforts are underway to rescue some more persons, who are suspected to have been trapped under the debris, he said.

Personnel from the National Disaster Response Force (NDRF), fire department, GHMC besides, the police were engaged in rescue operations, the senior police officer said.

Heavy rain lashing the city since two days seem to be the reason behind the collapse, he added.

10 hurt as plane's landing gear collapses at New York airport

NEW YORK: The front landing gear of a flight arriving at New York's LaGuardia Airport collapsed on Monday right after the plane touched down on the runway, officials said, sending the aircraft skidding before it came to a halt.

Ten passengers were treated at the scene, with six being taken to a hospital with minor injuries, said Thomas Bosco, Acting director of aviation for the port authority of New York and New Jersey, which oversees the area airports. The six crew members were taken to another hospital for observation.

Dallas-based Southwest said there were 150 people on Flight 345 coming from Nashville, Tennessee, while the Port Authority said the total was 149.

Bosco said the nose gear of the plane collapsed when it landed at 5:40 pm, and "the aircraft skidded down the runway on its nose and then veered off and came to rest in the grass area."

Bosco said there was no advance warning of any possible problem before the landing.

Emergency crews were seen spraying foam toward the front end of the plane on the tarmac. The port authority said the passengers exited the plane by using emergency chutes.

The airport was temporarily closed, but one of two runways was operating shortly after 7 pm, and Bosco said the port authority was hoping to have the airport fully open by Tuesday morning.

The federal aviation administration is investigating, as is the national transportation safety board.

Richard Strauss, who was on a nearby plane waiting to take off for Washington, said the nose of the plane was "completely down on the ground. It's something that I've never seen before. It's bizarre."

A rear stairwell or slide could be seen extending from the Southwest aircraft, said Strauss, who owns a Washington public relations firm. His plane, which was about 100 yards (90 meters) from the Southwest flight, wasn't allowed to taxi back to the gate, he said.

Bobby Abtahi, an attorney trying to catch a flight to Dallas, was watching from the terminal and heard a crowd reacting to the accident.

"I heard some people gasp and scream. I looked over and saw sparks flying at the front of the plane," he said.

The incident came 16 days after Asiana Flight 214 crash-landed at San Francisco's international airport on July 6, killing two Chinese teenagers; a third was killed when a fire truck ran over her while responding to the crash, authorities said. Dozens of people were injured in that landing, which involved a Boeing 777 flying from South Korea.

Longtime pilot Patrick Smith, author of "Cockpit Confidential: Everything You Need to Know About Air Travel. Questions, Answers, and Reflections" and AskthePilot.com, said landing gear incidents are not high on the list of worries for pilots.

"It doesn't happen very often but I need to emphasize just how comparatively minor this is and how far, far down the hierarchy it is," he said. From a pilot's perspective, this is nearly a non-issue. They make for good television, but this is far down the list of nightmares for pilots."

Congress leaders said the brother-sister duo's chopper would land at the Indira Gandhi International Aviation Academy in the morning from where they will go to the Sanjay Gandhi guest house in Munshiganj. They will then meet local party workers and assess the party's preparedness for the forthcoming Lok Sabha elections.

"There are not too many official engagements of the Congress vice president. He is very keen on one-on-one meetings with the local leadership and grassroot workers to understand their problems viz-a-viz the state's ruling Samajwadi Party (SP). He will also inform workers about various projects and schemes like food security of the Manmohan Singh-led UPA government at the Centre," a local leader said.

Both Rahul Gandhi and Priyanka would participate in an event at the Central Reserve Police Force (CRPF) station at Trisundi in Bhadar July 25. Sources said Union minister for home affairs Sushilkumar Shinde is scheduled to attend the function.

Rahul Gandhi and Priyanka will fly back to New Delhi the same day.

Gujarat terror remarks: Shakeel Ahmed meets Sonia Gandhi

NEW DELHI: Congress leader Shakeel Ahmed on Tuesday met party chief Sonia Gandhi in the wake of controversy over his remarks linking 2002 Gujarat riots with birth of terror outfit Indian Mujahideen even as he accused BJP of diverting the nation's attention from NIA's "observations".

"By dramatised hue & cry BJP spokespersons are trying to make it my statement simply to divert the nation's attention from NIA's observations," Ahmed said on Twitter.

He later stated that he was only saying what the NIA had said earlier.

Army orders investigation in alleged burglary by its personnel in Arunachal

ITANAGAR: An investigation has been ordered into alleged involvement of four army personnel in a burglary and cheating case at Banderdewa near here recently, officials said on Tuesday.

The army is examining the veracity of the incident, Defence PRO based at Tezpur in Assam's Sonitpur district in a communique said.

"In case found guilty, strict action will be taken against the defaulters and no acts of indiscipline by our troops will be tolerated," the communique said.

On the reported recovery of weapons (AK-47), magazines, 180 live rounds of ammunition, the army termed it as "baseless" saying "these are weapons, ammunition and equipment carried by army personnel as they are authorised as per the nature of their duty.

"These are not recoveries," it added. The communique said, "It is regrettable that an incident has occurred wherein army personnel, who acting on a tip off from an informer on a likelihood of an illegal weapon in a house of an anti-social element, launched an operation to recover it, have been alleged to be involved in extortion."

Stating that a case has been registered against these personnel who along with some civilians were allegedly involved in extortion of money from Tana Karan of Duimukh, it observed, "News of this nature and naming the Army only attempts to malign the image of the force which has been working tirelessly to usher in peace and tranquillity in North East." The numerous social and community development projects undertaken that have benefited large sections of the general population are testimony to the noble intentions of the army," the communique added.

THIRUVANANTHAPURAM: Several trains to Kerala from north India have been diverted due to incessant rain and track washout between Sindi and Tuljapur railway stations under the Nagpur railway division. Due to the diversions, trains passing through the western section have been running late.

Authorities said the New Delhi-Thiruvananthapuram Central Kerala Express (Train No. 12626) which left New Delhi on Sunday has been diverted via Itarsi Junction, Khandwa, Bhuasaval Junction, Badnera Junction and Balharshah stations of Western Railway. Due to diversion, train will arrive late at Thiruvananthapuram Central Station by a few hours.

Also, the Gorakhpur-Thiruvananthapuram Central Express (Train No. 12511), which left Gorakhpur on Sunday, was diverted via Itarsi Junction, Khandwa, Bhuasaval Junction, Badnera Junction and Balharshah stations of Western Railway.

At the same time, Thiruvananthapuram Railway Division authorities have informed that the Thiruvananthapuram - Korba Express (Train No. 16328) scheduled to leave Thiruvananthapurma Central at 5.45am on Monday has been rescheduled to leave Thiruvananthapuram Central at 11.30 am on the same day due to late running of the pairing train. The time of departure was rescheduled as per the direction from the Southern Railway authorities.

Hijacked MV Cotton back under control of Indian crew: Govt

NEW DELHI: All 20 Indian crew members aboard chemical tanker MV Cotton, hijacked by suspected pirates off the coast of Gabon last week, are safe and the ship is back under their control, ministry of external affairs said on Monday.

"MV Cotton back under control of crew. All crew of MV Cotton safe," ministry spokesperson Syed Akbaruddin tweeted.

The Turkish-owned, Maltese-flagged tanker was believed to be hijacked on Sunday while awaiting berthing in the Gulf of Guinea.

The owners of the 2007-built MV Cotton had lost contact with the tanker late on Sunday.

Tamil Nadu seeks one more month to implement revised auto fares

CHENNAI: The Tamil Nadu government on Monday sought one more month from the Supreme Court to implement the revised autorickshaw fares in the state.

The state government was supposed to file a compliance report on Monday as the apex court had earlier set a two-month deadline to revise the fare.

Talking to TOI, advocate SV Ramamurthy, who filed the PIL in the Supreme Court and who was present in the court on Monday, said: "The advocate general representing the state said that one more month would be required as the state plans to introduce GPS-enabled metres and that more discussions would be needed."

The case was heard by Justice F M Ibrahim Kalifulla. "The judge imposed a fine of Rs 10,000 to the state government for the delay," said Ramamurthy.

On May 6, the apex court gave the government, which had already failed to meet a January deadline, two more months to come up with the new fares and an additional fortnight to ensure that it puts the system in place.

A sustained campaign by The Times of India, attempts by activists and consumer rights organisations and the apex court's deadline gave commuters reason to anticipate the end of the tyranny of meterless autorickshaws. But delays in various government departments have let auto drivers off the hook.

UCB files cases against Ranbaxy, Aurobindo, Glenmark, others

HYDERABAD: UCB, a global biopharma company, alongwith others has filed separate cases against as many as 15 drug makers, including India's Ranbaxy, Aurobindo, Zydus, Sun Pharma, Glenmark and Alembic Pharmaceuticals for allegedly infringing its patented drug Vimpat.

According to a petition filed by UCB, Inc, UCB Pharma GMBH, Research Corporation Technologies, Inc and Harris FRC Corporation the patent its drug Lacosamide Tablets, 50 mg, 100 mg, 150 mg and 200 mg would expire on March 17, 2022.

The patent infringement petition was filed in the US District Court for the district of Delaware.

For the 12 months ending March 31, 2013, Vimpat had US sales of approximately $338 million, according to IMS Health.

The drug is approved as an adjunctive therapy to treat partial-onset seizures of people diagnosed with epilepsy aged 17 years and older.

According to petitioners, the patent which belonged to RCT, granted the licence to Harris.

Harris in turn sub-licensed the patent to Schwarg which was acquired by UCB SA along with rights on Lacosamide.

The licence agreement between Harris and Schwarg was restated and amended for all countries of the world by and among Harris, UCB Pharma GMBH and UCB Sa.

"Aurobindo Ltd submitted its ANDA to the FDA for the purpose of obtaining approval to engage in the commercial manufacture, use, offer to sale sale and or import of Aurobindo Ltd's AMNDA products before expiration of the 551 patent.

"By filing it ANDA under... before the expiration of the 551 patent Aurobindo Ltd has committed an act of infringement," the petitioners alleged in case of Aurobindo.

Reacting to the petition, Mylan in a statement said it believes it is one of the first companies to have filed a substantially complete ANDA containing a Paragraph IV certification for this product and expects to be eligible for 180 days of marketing exclusivity upon final FDA approval.

Glenmark while confirming the petition against it, in a statement said: "If Glenmark is successful in its challenge of the patent, it will garner 180-day exclusivity for its products."

The petitioners requested the court to issue a permanent injunction and enjoining the respondents from engaging in the commercial manufacture, use offer to sell or import until the expiration of the patent or any later date of exclusivity to which the petitioners are entitled.

The patent infringement petition was filed against Aurobindo Pharma Ltd, Accord Healthcare Inc, Alembic Pharmaceuticals Ltd, Amneal Pharmaceuticals, Apotex Corp, Breckenridge Pharmaceutical Inc, Glenmark Generics , Hetero USA Inc Mylan Pharmaceuticals Inc.

Petitions were also filed against Ranbaxy Laboratories Ltd, Sandoz Inc, ScieGen Pharmaceuticals Inc, Sun Pharma, Watson Laboratories Inc and Zydus Pharmaceuticals

Aircraft carrying Sushma Swaraj develops technical snag, lands at Jaipur

NEW DELHI: An aircraft carrying leader of the opposition in Lok Sabha Sushma Swaraj from Delhi to Ujjain on Monday developed a technical problem and was forced to land at Jaipur airport.

"Took off for Ujjain this morning. Landed in Jaipur due to a technical snag in the right engine of the aircraft," Swaraj said on her twitter handle.

The BJP leader flew in another aircraft to Indore from where she is likely to go to Ujjain by road.

"Its all fine. Nothing to worry," Swaraj said. BJP has launched its election campaign in poll bound Madhya Pradesh. Swaraj, who is MP from Vidisha, will be participating in various programmes for her party.

ALLAHABAD: The Allahabad high court on Monday reserved its order on the controversial reservation policy introduced recently in Uttar Pradesh whereby caste-based quotas were brought in at the preliminary stage itself that had led to violent protests in the city over the issue.

The court also asked the state Public Service Commission not to conduct interviews for the ongoing civil services examinations for the next 10 days.

A division bench comprising Justices Laxmi Kant Mohapatra and Rakesh Srivastava reserved their judgement on a bunch of petitions filed by hundreds of students appearing in competitive examinations, who had challenged the aforesaid reservation policy.

Consequently, the interviews which were to commence on July 26 would now have to be rescheduled and by that time the verdict on the matter is also likely to be delivered.

Appearing on behalf of the petitioners, senior advocates, including Keshri Nath Tripathi and Ravi Kiran Jain told the court that the new reservation policy was "illegal" and "unconstitutional" and intended to benefit candidates from "only one caste group considered close to the ruling party in the state".

The court also questioned the UPPSC's "haste" in bringing in the new policy after being told that it was "passed by voice-vote after one of the members of the commission brought forth the proposal".

The petitions were opposed by the UPPSC, which was represented by counsel Shashi Nandan, and the state government, through additional advocate general C B Yadav.

The three-tier reservation system introduced by Uttar Pradesh Public Service Commission, which proposes caste-based quotas from the preliminary exams stage itself, has drawn flaks from students and several political parties.

Meanwhile, massive security arrangements are in place in the city in the wake of the violent protests over the issue that had rocked the city on July 15.

As precautionary measures, the district administration has ordered closure of all schools on Monday and Tuesday (today and tomorrow).

Traffic has been diverted on all roads leading to the UPPSC headquarters here with heavy barricading and deployment of forces in place.

Nearly 3,000 personnel of police, Provincial Armed Constabulary and Rapid Action Force have been pressed into service to keep a tight vigil even as senior officials are patrolling the areas where students are carrying out their agitations.

German intelligence used NSA programme to spy on citizens

BERLIN: Germany's two main intelligence services used a special surveillance programme of the US to collect vast amounts of communications data, even as the government continued to deny prior knowledge of such operations, a report claimed today.

Top secret National Security Agency (NSA) documents leaked by former CIA contractor Edward Snowden reveal that Germany's external intelligence service BND and its domestic counterpart, the Federal Office for the Protection of the Constitution, were equipped with the programme code-named "XKeyScore," the weekly news magazine Der Spiegel said.

It was described as "a comprehensive programme capable of monitoring and collecting the metadata, information about the origin and destinations of connections and to find out what terms a particular person has used in a search engine" in an internal NSA presentation.

The purpose of the programme was to strengthen BND's ability to support the NSA in the fight against terrorism.

It also had the responsibility of training the domestic agency on how to use the programme, Der Spiegel said.

The system is also capable of storing a "full take" of all unfiltered data for several days, including at least a part of the content of the communications, the magazine added.

Out of around half-a-billion internet and telephone connections from Germany monitored every month by the NSA, a major part is collected with the help of the "XkeyScore" programme.

Around 180 million data was collected in December 2012, the news weekly said.

The documents also showed that cooperation between the German intelligence agencies and the NSA has intensified recently and the BND has expressed its desire to work more closely.

The NSA said in January that the BND "has been working to influence the German government to relax interpretation of the privacy laws to provide greater opportunities for intelligence gathering," Der Spiegel said.

Since the first documents leaked by Snowden revealing details of the NSA's sweeping surveillance programmes were published in the media at the beginning of June, the German government has claimed that it had no prior knowledge.

Meanwhile, former NSA director Michael Hayden said that the United States had agreed with its European partners shortly after the terrorist attacks on September 11, 2001 to create a kind of information pool to facilitate speedy exchange of information among their intelligence agencies, he said in a TV interview.

1,300 people shifted as river Godavari level rises in Andhra Pradesh

RAJAHMUNDRY(AP): Over 1,300 people have been shifted to rehabilitation camps in East Godavari district after water level of Godavari river at Dowleswaram barrage rose alarmingly following heavy rain.

The second flood alert in the district was issued yesterday, an official said.

District collector Neetu Kumar Prasad, and other senior administrative and police officials were visiting the flood-affected areas in the district today and measures have been initiated to prevent further damage, including of roads, which were severely affected by heavy rains.

Over 17 lakh cusec water discharged to sea as Godavari at Dowleswaram was receiving heavy inflows due to rains in the catchment areas.

"We are monitoring the situation at Dowleswaram. Officials are taking stock of the situation and checking various irrigation sources situated in the district. The Godavari and its tributaries--Gouthami, Vashita Godavari and other rivers are in spate," the official said.

Due to this, the low-lying villages in Polavaram are severely affected, he said.

Over 1,300 persons were shifted to various relief camps - about 700 from Konaseema and 600 from Devipatnam agency area and other places.

The relief and rehabilitation works are in full swing in the district.

Rampachodavaram sub-collector Gandham Chandrudu said that mechanised and country made-boats were pressed into service in the agency area of Devipatnam and other places to shift the people to relief camps.

The roads were submerged in the agency areas and traffic was severely affected.

The National Disaster Response Force (NDRF) was assisting the administration in shifting the people to safer places and meet the needs of the flood-affected people, he said, adding that the tourists were not being allowed to visit Devipatnam due to flood.

Egypt begins work on charter as Islamists press demos

CAIRO, Qahirah: Experts begin work on Sunday to amend a divisive constitution rammed through by ousted Egyptian president Mohamed Morsi, while his supporters called for intensified rallies in Cairo demanding his reinstatement.

Egypt's caretaker cabinet has sought to forge ahead with an army "roadmap" for a political transition amid heightened tensions as Morsi's Islamist supporters press on with the protests that have sparked bloody violence.

Foreign minister Nabil Fahmy launched a public relations campaign to boost the cabinet's credibility abroad on Saturday, nearly three weeks after the military toppled Morsi in a popularly backed coup.

On the domestic front, interim president Adly Mansour named a committee of four university professors and six judges to come up with a new constitution.

In the wake of the July 3 coup, Egypt's new army-backed administration suspended the constitution that had been drawn up by an Islamist-dominated panel and adopted by referendum in December with a majority of 64 percent, but with a voter turnout of just 33 percent.

The experts will have 30 days to complete their task, after which their amendments will be brought before a 50-strong body representing different groups in Egyptian society, which will submit final changes to Mansour.

The caretaker president will then have 30 days to call a referendum on the new charter, paving the way for new elections.

Work also began in earnest at the weekend on boosting the new regime's foreign relations.

Fahmy said on Saturday he would prioritise "defending the revolution abroad".

The ministry would "form a committee to follow what is published about the revolution abroad and to provide sound information," he told a news conference.

Morsi's overthrow has received a mixed reception abroad.

The African Union has suspended Egypt's membership, but some Gulf countries that distrusted Morsi have pledged billions of dollars in aid.

Britain has said it was revoking export licences for equipment used by Egypt's military and police amid concerns it could be used against protesters.

Fahmy also took a more cautious tone towards the conflict in Syria than Morsi's government did, saying Morsi's decision to cut diplomatic ties with the war-torn country would be "re-examined".

Morsi had repeatedly called on Syrian President Bashar al-Assad to resign.

"There is no intention of jihad in Syria," the former Egyptian ambassador to Washington said, in reference to calls for a holy war in Syria under Morsi's presidency.

Fahmy was due to meet the new leader of Syria's main opposition coalition, Ahmad Assi Jarba, on Sunday.

In a boost to the new administration, King Abdullah II of Jordan became the first foreign head of state to visit since the army ousted and detained Morsi.

King Abdullah pledged his support "for Egyptian national choices", a presidential statement said.

But Morsi's supporters have flatly rejected the legitimacy of the interim cabinet.

They called for fresh rallies in the capital on Sunday to demand the reinstatement of Morsi, planning marches to several foreign embassies in Cairo, including that of the United States.

Supporters of Morsi, who was ousted after a single year of turbulent rule, have pressed demonstrations against the new cabinet, holding marches and protests across the country since his fall.

Thousands of Morsi loyalists have massed in Cairo's Rabaa al-Adawiya square for about three weeks, calling for his reinstatement and denouncing General Abdel Fattah al-Sisi, the army chief behind his overthrow.

They believe a sustained campaign of protests could persuade the military to restore him briefly ahead of any elections.

Although mostly peaceful, the pro-Morsi protests have resulted in deadly clashes, with the unrest claiming more than 100 lives in all, according to an AFP tally.

Three dead, including two Britons, in Russia helicopter crash: Reports

MOSCOW: At least three people, including two British citizens, were killed in Russia's Far North on Sunday when a helicopter crashed into them while they were standing on the ground, officials said.

A distress signal had already been received from the Eurocopter-120 before it made the hard landing on the north of the Kola peninsula in the Murmansk region.

"Three people were killed, two of them are British citizens," the local branch of the emergencies ministry said in a statement on Russian news agencies.

RIA Novosti said that the two foreigners were believed to be tourists. The identity of the other individual said to have been killed was not immediately clear.

Reports said the three appeared to have been crushed to death by the helicopter while standing on the ground and were not inside the aircraft at the time of the crash.

"After take-off, the helicopter tilted and fell onto its side. Three people who were on the ground at the time died of their injuries," a source in Russia's aviation agency Rosaviatsia told the RIA Novosti news agency.

Reports said it was possible that the tourists had been taken by helicopter to the remote area for fishing and then killed by the aircraft after it had deposited them in bad weather.

The Life News website described the Britons as "VIP tourists" who were taking part in a fishing trip especially for foreigners.
