Blog: When Bedi was in the dock

The objections raised by the legal fraternity over Kiran Bedi being named as BJP's Delhi CM candidate apparently belong to a bygone era, when she was in the thick of her chequered police career. But the gravity of the findings given against her 25 years ago by the Justice D P Wadhwa Committee still provides much cause for concern.

The inquiry conducted by Justice Wadhwa, who was then a judge of the Delhi high court before his elevation to the Supreme Court, was into three incidents in which Bedi, as deputy commissioner of police in charge of north Delhi district, had clashed with lawyers in early 1988. The report submitted in February 1990 faulted both sides, in varying degrees and for different reasons.

Wadhwa pulled up lawyers for going on strike after one of them, Rajesh Agnihotri, had been apprehended on January 15, 1988 allegedly in the act of stealing inside the ladies common room of St Stephen's College. The provocation for the strike was that Agnihotri had been taken to the court handcuffed. On this incident, Wadhwa said while Agnihotri's arrest was "legal and justified, his handcuffing was illegal". But he added, "Even if the ire of the lawyers was justified, they could not have gone on an indefinite strike on this issue. At the same time, it was unnecessary and even improper on the part of DCP (North) to go to the press and make misleading statements."

The second clash took place on January 21, 1988, a day after Bedi had at a press conference called Agnihotri a "thief" despite his judicial discharge. In response, a group of 100 lawyers demanded to meet Bedi in her office which was located in the same Tis Hazari court complex. This led to what Wadhwa described as a "brutal and merciless lathicharge" in which about 30 lawyers and journalists were injured.

Even as he held that the lawyers were "not justified" in going to Bedi's office "to extract an apology from her and to lodge protest against her press conference", Wadhwa said that "they certainly could not be said to have constituted an unlawful assembly." Further, even as he rejected the allegation of lawyers that Bedi herself had come out of her room and shouted "Maro Salon Ko", Wadhwa said that the lathicharge had been "ordered at the instance of Kiran Bedi… without any lawful excuse." As a corollary, the judge recommended the withdrawal of the case of rioting that had been booked against lawyers on "false evidence" after 16 of them had been "wrongly arrested" after the lathicharge.

Calling the FIR "a false document", Wadhwa said: "Lathicharge was the result of personal vendetta which Kiran Bedi was nursing against the lawyers and was without any provocation." While debunking her version of the clash, Wadhwa pointed out the contradiction between contemporaneous police records and the claims she had subsequently made before the committee.

In her deposition before the committee, "Kiran Bedi said that a group of lawyers which stormed into her office, rushed towards her making violent gestures and uttering obscenities at her and further that these lawyers made physical gestures and gave threats to the effect that they would strip her and throw
her down and used unmentionable utterances directed at the female anatomy and actually advanced towards her threatening to carry them out."

Such alleged acts constitute an offence under S 509 IPC which penalizes anybody who, intending to insult the modesty of a woman, utters any word or makes any sound or gesture in her presence. Yet, the FIR registered by one of her subordinates, sub-inspector Jinder Singh, did not allege that any of the lawyers had entered Bedi's room, let alone giving details of their alleged sexual crime. Though he recorded the statements of six witnesses on that day, Jinder Singh did not examine Bedi who would be, as the committee put it, "the complainant as to what had happened in her office".

Asked about these omissions, Bedi said to the committee, "To me Jinder Singh wrote what he saw. Therefore, I thought that he would come back and I will put my case during investigation to him. Also, the incident in my office concerned me individually."

Justice Wadhwa wrote: "I am quite intrigued by the last line of the reply. Outraging the modesty of a woman, even if that be a lady police officer, concerns the society as a whole. The offence is cognizable and is compoundable only with the permission of the court. Either Kiran Bedi failed in her duty in registering the FIR for an offence under S 509 IPC or she is not telling the truth. I would rather hold that she is not telling the truth and the lawyers never entered her office and uttered obscenities in her office at her."

As for the third incident probed by the committee, involving a mob attack on the chambers and cars of lawyers in Tis Hazari on February 17, 1988, Wadhwa's findings are entirely against Bedi and the police. He said that the mob of about 4,000 men had been brought by municipal councillor Rajesh Yadav "in connivance with Kiran Bedi". Citing errors of omission and commission on the part of the police and the discrepancies in the transcripts of their wireless messages and their testimonies, Wadhwa said that Bedi's claim to have been unaware that the mob was heading towards Tis Hazari courts and that it was shouting slogans in her favour till she herself reached there "is false; it is a lie".

Some of the details of the connivance established by the inquiry were that the mob had been organized and transported with the "help" of officials from Samepur Badli and Shalimar Bagh police stations, that "intentionally no steps were taken to stop the mob en route or even at the gates of Tis Hazari courts", that "the crowd was allowed to indulge in vandalism without any check", that "even the assembly was not declared as unlawful", that Bedi sent a report "which was dishonest". Holding that Bedi and her subordinates had hatched a "conspiracy" with Yadav, Wadhwa said that "object was to take out a demonstration … so that mounting pressure of the lawyers for seeking action against Bedi and her consequent suspension be eased by showing that public opinion was in her favour."

Her advocate, K T S Tulsi, was quoted as saying that she was "a high profile officer and throughout had a brilliant academic career and outstanding record of service." Wadhwa brushed him aside saying, "I have nothing to say if the record of service of Kiran Bedi has been exemplary or her academic career excellent. But her role in the three incidents, which I am inquiring into, does not commend to me."

"She certainly had a great deal of influence on her subordinates. They fell all too easily under her spell and filed affidavits in these proceedings which were not true and they did so in order to bail her out. She, on her part, shifted responsibilities for the illegalities committed by her on her colleagues and subordinates though claiming only moral responsibility. I find this conduct of her deplorable. Because of the popularity which Kiran Bedi was enjoying on account of the good deal of publicity in the newspapers and TV media and the influence which she had with the powers that be, even the senior officers in the police headquarters just caved in and adopted an attitude of see nothing, hear nothing and do nothing, even when it was so obvious that grave illegalities had been committed," Wadhwa observed.

In an "action taken note" tabled along with the Wadhwa report in Parliament on April 19, 1990, the then home minister, Mufti Mohammad Sayeed, announced that it had been decided "to initiate departmental action against the officials concerned". Nobody could have imagined then that 25 years later, Sayeed and Bedi, in their respective states, would both be CM candidates. More importantly, in keeping with the general culture of impunity, little is known though of whether the first woman IPS officer in India was ever held to account for the "grave illegalities" she had been indicted for by a judicial inquiry.

SC bans Google from showing sex determination ad

NEW DELHI: The Supreme Court of India on Wednesday ordered Google, Yahoo and Microsoft to stop showing ads related to pre-natal sex determination in the country.

The country's top court ruled that such advertisements violate the Pre-Conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Act of 1994.

The three companies have also been asked to update their 'terms of service' to include this order.

Further hearings about this issue will be held in February.

In December, the Supreme Court had made its displeasure known over the central government's inability to restrict online content that violates the nation's rules.

Sex determination, though illegal, is still practised in India, which is grappling with a severe male-female ratio. According to UN data, India's sex ratio has been on a steady decline: from 976 girls to every 1,000 boys in 1961, the figure for the girls has come down to 918.

Prime Minister Narendra Modi has spoken on this issue several times, most recently during a rally in Haryana. US president Barack Obama, during his 3-day visit to India, also said that the growth of a nation depends on the growth of the female population.

Facebook, Instagram back after 40 minute outage

NEW DELHI: After an outage of more than 40 minutes, social networking website Facebook and its photo sharing service Instagram are back online.

Facebook, appeared to be down on Tuesday morning (Indian time), and the social media site acknowledged there was an issue without getting into the details. The company's photo sharing website Instagram too was down with users experiencing issues logging in.

"Sorry, something went wrong. We're working on it and we'll get it fixed as soon as we can," Facebook returned this error when users tried to login.

Users from the United States and India reported that they were unable to log on to the website.

According to a Reuters report, Facebook executives were not immediately available for comment. Some users also reported that dating app Tinder was also down.

Interestingly, a number of users responded with hilarious tweets about the outage on Twitter, tagging their tweets with the hashtag #SocialMeltdown2015.

The Republic Day parade ceremony will commence at Amar Jawan Jyoti at India Gate where Modi will lead the nation in paying homage to the martyrs by laying a wreath. As per tradition, after unfurling of the Tricolour, the National Anthem will be played with 21-gun salute. The parade will then commence and President Pranab Mukherjee will take the salute. The parade would begin with showering of petals by IAF helicopters, which will also display the tricolour and flags of Army, Navy, and Air Force.

Children are the future of the republic but our schools are failing them

Happy Republic Day to all! As you enjoy watching the parades and celebrate President Obama's presence in our midst, i would like to draw your attention to something important. A significant survey was released two weeks ago with major implications for the future of our republic, even as it got lost amongst the politics served hot by TV channels.

Called the Annual Status of Education Report or ASER 2014, it is the tenth such survey. Facilitated by NGO Pratham and conducted by local district-level organisations, ASER is the largest, most comprehensive annual household survey of children in rural India. ASER 2014 reached 16,497 villages and about 570,000 children were covered.

First, the good news. Enrollment levels at schools are 96%. Most of our kids go to schools now. Other good news includes a functioning mid-day meal programme (over 85% of schools) and improved infrastructure. Around 75% of rural schools have drinking water while 65% have toilets, significantly higher than five years ago.

However, the biggest concerns arise from what is actually happening inside the school. Which is to say, how the school does in terms of what it is meant to do — teach students.

Detailed results are available online, but here are three quick data points. Half the kids in class V cannot read simple sentences that are taught in class II. Half the kids in class V cannot do basic two-digit subtraction which is taught in class II. Half the kids in class VIII cannot do simple division that is taught in class IV.

There you go. Half of our school students, after spending six years in school, cannot read basic sentences or perform simple arithmetic. The same could have been learnt within two to three years in a good private urban school.

So what are we doing in our rural schools, and what kind of talent are we creating? Are we simply going to celebrate enrollment and mid-day meal figures, and forget about the school's core job — to educate? What is literacy anyway? Is it just being able to write one's name, or is it at a minimum being able to read and solve basic arithmetic problems?

Why is basic reading and arithmetic vital? Because almost all education in subsequent years assumes these skills. Adding more years of education to such students will be a waste. Data shows if basic skills are not learnt well early they won't be learnt later, nor would anything advanced. These students will be the laggards, counted in our enrollment but eventually not getting educated.

If this were a small percentage of students, we would live with it. That it is more than half our students shows a major failure in our educational system. This can be changed. It is fixable provided we first realise the gravity of the problem and then prioritise it in government.

Sadly, our so-called intellectual and political debates have been reduced to personality contests. With no known face attached to this problem we don't care much, hence the media ignores it as well.

However, these millions of kids and their families are being cheated and shortchanged by us. We, the well educated, frankly don't give a damn about rural kids as they are too different from people like us. However, if we don't fix the problem, we will have hundreds and millions of job seeking, hungry youth with little qualification and no educated worldview in the next decade or two. If we don't want this time bomb of human mediocrity to explode on us, let us work on reforming rural education now.

Here are some workable ideas. First, use technology. There is a shortage of good teachers, but if we bunch up a few schools in the same area and use a combination of virtual classes (conducted by more senior teachers) and physical classes (with less skilled teachers), we can have significant efficiency gains. A national classroom won't work given early education requires individual attention. But local clustering using technology will work well.

Second, have reporting systems. Opening a school and admitting students is not enough. Like any service provider, it needs to run well on a daily basis. Tracking actual change in skill level of kids, rather than counting bodies in the building, will go a long way. For this, centralised technology can be used.

Third, change the class- and grade-based system. The class I to XII system may not work so well for early years. Unless a student has basic skills, he or she should not be sent to higher classes. While nobody wants to stress little kids with exams and tests, we have to create hurdle markers based on actual learning in the early years.

Fourth, modify the course content. Our course materials are dated. The rote learning we subject our kids to not only prevents grasp of a concept, it allows students to keep moving up the system despite not gaining any real skills of comprehension or logic.

These are just a few suggestions. Many brilliant minds in the country can suggest more. Solutions will come, but what is needed is a desire among citizens to address what is important rather than what is sensational. More than half our students are not even being half educated. Now does this deserve our full attention or not?

7 reasons why Obama's 2nd visit to India is important

US President Barack Obama arrived in India on Sunday for the second time, to build on what he calls one of the defining relationships of the 21st century.Obama's visit is a fresh bid to make Asia's third-largest economy an enduring strategic partner and nurture his friendship with Prime Minister Narendra Modi, who broke with protocol to meet and bear-hug Obama when he landed in New Delhi.Following are some key areas likely to be discussed during his visit:
1.

Strategic importance

India's size, location, fast-growing economy and potential as a democratic counterbalance to China makes the South Asian nation an increasingly key element of US military and commercial strategy. In return for closer ties, India wants greater cooperation on terrorism and access to high-technology goods for civilian and military use.

2.

Defence

The United States overtook Russia as the biggest weapons supplier to India, the Indian government said in August. India is the world's biggest importer of weapons and the United States is the biggest arms supplier. Standing in the way of closer ties are Indian restrictions on foreign companies owning majority stakes in defence companies and US curbs on exporting certain technologies.

3.

Civil nuclear

US and Indian officials will discuss ways to unblock billions of dollars of potential trade in nuclear energy. India and the United States signed a landmark civilian nuclear deal in 2008. Holding up the trade is India's reluctance to pass legislation shielding suppliers from liability in the event of a nuclear accident, a deviation from international norms.

Renewable energy

India wants companies from the United States to help lead investments of $100 billion in renewable energy. Prime Minister Narendra Modi promised to help renewable energy companies overcome entry to the Indian market during his trip to Washington last year. A barrier to investment is a requirement that foreign companies make much of the equipment within India, which business leaders say will push up costs.

Climate Change

The United States and India are expected to announce efforts to work together to combat climate change ahead of key global talks in Paris later this year. India, the world's third largest carbon emitter, is reluctant to follow the United States and China in committing to a peak year for emissions on the grounds it needs economic growth to alleviate poverty. Instead, India is likely to trumpet its plans for a rapid expansion of renewable energy, for which it needs US investment and technology, and improving energy efficiency.

Economic Ties

Modi and Obama last year targeted a five-fold increase in annual trade to $500 billion. But US business leaders have been frustrated by limits on their access to the Indian market, and battles over intellectual property protection. India and the United States have also filed several cases against each other at the World Trade Organisation over protection of their domestic steel, poultry and solar industries.

Sharing intelligence inputs

In the secret world of intelligence, where trust is a commodity best not discussed, the US and India have emerged as very unlikely partners. The US is today the most important supplier of intelligence and information to India, from being a rival until a few years ago, sources across intelligence and security agencies say.

Indian and Pakistani troops along the Line of Control exchanged sweets at three places in J&K on the occasion of Republic Day. The programme

The Republic Day parade ceremony will commence at Amar Jawan Jyoti at India Gate where Modi will lead the nation in paying homage to the martyrs by laying a wreath. As per tradition, after unfurling of the Tricolour, the National Anthem will be played with 21-gun salute. The parade will then commence and President Pranab Mukherjee will take the salute. The parade would begin with showering of petals by IAF helicopters, which will also display the tricolour and flags of Army, Navy, and Air Force.
