Special CBI court frames corruption charges against Justice Nirmal Yadav

CHANDIGARH: Finally, the special CBI judge on Saturday framed charges on corruption against the controversial former high court judge, Justice Nirmal Yadav for her alleged involvement in the cash-in-bag scam that had rocked the entire judiciary in 2008.

Justice Yadav has been charged under Section 11 of the Prevention of Corruption Act (Public servant obtaining valuable thing without consideration from person concerned in proceeding or business transacted by such public servant).

The President had given the sanction to prosecute her on March 1, 2011.

Justice Yadav was evading the trial proceeding for a long time and had filed various petitions before the high court and supreme court to delay the proceedings.

Besides Justice Yadav, the court also framed corruption charges against advocate Sanjeev Bansal, businessman Rajiv Gupta and Delhi-based hotelier and alleged kingpin of the scam, Ravinder Singh Bhasin, under Section 120B (criminal conspiracy) and Section 12 of the Prevention of Corruption Act.

The court also framed charges against Bansal, Rajiv Gupta and Nirmal Singh, a city-based businessman, under 120 B (criminal conspiracy) and various other sections of the IPC relating to making false statements and fabrication of evidence).

The case had rocked the judiciary in August 2008 when a bag containing Rs 15 lakh in cash was "wrongly delivered" at the residence of Justice Nirmaljit Kaur, following which she reported the matter to the police.

The money was allegedly delivered by Parkash Ram, a clerk of former Haryana additional advocate general Sanjeev Bansal, the prime accused in the case.

Later, the CBI investigations found that money, delivered mistakenly at the doorstep of Justice Nirmaljit Kaur, was actually meant for Justice Yadav for payments towards a land deal.

The agency had also found that Justice Yadav required Rs 15 lakh on August 13, 2008 to pay for a plot of land purchased in Solan district in Himachal Pradesh.
