A three-member team of CBI Delhi led by deputy superintendent of police K S Negi reached Datia on Sunday and collected the copy of FIR and other details from the police station, said sources.
Madhya Pradesh high court had ordered a CBI probe into Ratangarh temple stampede on November 12 in response to a public interest litigation (PIL) that demanded probe into the stampede by a central agency.
Double bench of Madhya Pradesh high court comprising Justice S K Gangele and Justice G D Saxena had ruled it is an exceptional situation and stated that it is necessary for the court to order an investigation by the CBI to restore credibility and confidence in the minds of citizens that their precious fundamental rights are guaranteed under Article 21 of the constitution.
The order further said that the CBI shall conduct an investigation in regard to four points whether the police personnel sought money from locals and permitted them on to the bridge, whether police resorted to lathi-charge, whether rumours were floated that the bridge has collapsed, whether police and administrative authorities had thrown bodies of injured or dead into the river to minimize casualties and above-all whether the police and administration destroyed evidences in the case. Several eyewitnesses had claimed that the police even threw bodies and injured into the river to minimise casualties.
Meanwhile, the Union government revoked suspension of the then Datia Collector Sanket Bhondwe following state government's failure to send a confirmation of charges against the officer.
Bhondwe and then superintendent of police (SP) C S Solanki, sub-divisional magistrate and sub divisional officer of police (SDOP), Datia were suspended on recommendation of chief minister Shivraj Singh Chouhan holding them accountable for the incident after a review of the tragic incident. As per rule 3 of All-India Services (Discipline and Appeal) Rules, the state government had to intimate the Union government (Department of Personnel and Training - DoPT) within 15 days about the reasons of suspension, but to no avail. State government did not submit any reason.
The state government will have to issue a chargesheet to the officer within 45 days of the suspension and if the government fails, it will have to take permission of the Centre which generally gives another 45 days to issue the chargesheet. These rules are applicable to all three All-India Services (IAS, IPS and Indian Forest Service).
The then SP, Solanki will continue with his suspension as charges against him was sent to the home ministry. Besides, the commission headed by retired high court judge Rakesh Saxena has sought two months extension to complete its probe into the stampede at Ratangarh temple. Justice Saxena has written a letter to the state government in this regard on Thursday.
State government had constituted the judicial commission to probe the stampede on October 14. The commission headed by retired high court judge Rakesh Saxena and based at Gwalior was expected to submit its report within two months.
