The MCI had suspended his licence to practice in October 2010 on a complaint filed by Dr Kunal Saha, founding president of the voluntary group, People for Better Treatment alleging professional misconduct of taking huge amounts as bribe for recognising medical colleges. Additional secretary of MCI, Dr P Prasannaraj who had signed the suspension order confirmed that Dr Desai's suspension has not been revoked as the matter is still under investigation.
"It is atrocious that he is being allowed to practice without a licence. Without a licence he is like a quack. If the MCI, the apex regulatory body of doctors in the country, does not take any action in this context, then what is the validity of MCI's regulatory powers in the country? Then, any doctorwhose licence is suspended by MCI can practice," said Dr Saha who has written to the MCI urging them to take action on the reinstatement of Dr Desai.
So far the MCI has not even written to the Gujarat government regarding Dr Desai's reinstatement even though Dr Saha had written to Dr R K Srivastava, chairperson of the Board of Governors (BOG) of MCI soon after the reinstatement happened last month. "What has happened is very unfortunate. But we have to put up the issue in the BOG meeting before we decide our course of action," said Dr Prasannaraj.
Dr Desai was suspended by the state government from BJ Medical College following his arrest by the CBI in a disproportionate assets case in 2010. However, in 2012, he was given a clean chit in this case. "There are several cases against Dr Desai in different states. I have filed a case in the Gujarat high court against Dr Desai election to the Gujarat University senate. The university claimed that he was elected in the category of qualified physician which any person with an MBBS degree can contest. But how can he contest as a physician when his licence is still suspended," asked Dr Saha.
Meanwhile, yet another complaint has reached MCI regarding recognition of four seats for MCh (Urology & Genitourinary Surgery) in BJ Medical College. "Out of three faculty members, Dr Desai who is the only professor rank faculty does not have a licence to practice, while the other two are of associate and assistant rank. With no professor, B J Medical college is not eligible for any seats in MCh Urology at present. Since recognition of super specialisation seats is in the hands of the MCI, they ought not to have recognised the MCh seats since they knew that Dr Desai's licence is suspended," stated the complainant Dr K V Babu.
